Titan represented a subsidiary of a well-known listed company on an advance payment dispute against a construction company. The Taipei District Court ruled in our favor, siding with our complaint that the defendant breached the contract and defrauded the advance payment of NT$2,800,000 in bad faith.
The joint venture contract between the defendant and our client was meant for a co-investment construction case, yet, the defendant withdrew the advance payment, invested by our client, day after signing the contract, and led to the termination of the case consequently. Neither did the defendant give any explanation at that time nor did he attend the courts during the proceedings. Even more, the defendant wound the company up in order not to return the payment, claiming it was the insufficient of the advance payment that led to the closure, and requested to set off the debt. After our legal claims, the Court ruled in favor of our client, and the defendant had to return the advance payment of NT$2,800,000.

Dr. Yeh, with an S.J.D. and a J.D. from University of Pennsylvania, has over twenty years of experience and previously practiced at Taiwan’s Lee & Li as well as global law firm Sullivan & Cromwell LLP. Dr. Tsai earned a Ph.D. in international economic law from Peking University. He is licensed to practice law in Beijing, Shanghai and Taipei. Dr. Tsai is also a consultant of Beijing DHH Law Firm and worked at Lee and Li Attorneys-at-law in Taipei and Beijing Zhong Ying Law Firm in Beijing. Dr. Tsai’s practice mainly focuses on cross border M&A, international investment, and cross-strait transaction between Mainland China and Taiwan. Mr. Hsieh earned an LL.B. degree from National Taiwan University. He served as a law clerk in Taiwan High Court Tainan Branch court, R.O.C., and specializes in civil and criminal litigations, mining law, environmental related regulations, and Government Procurement Act. Mr. Lin earned an LL.M. degree from National Taipei University, has experience in defamation lawsuit, land disputes, corporate litigations, and contract review.
