Non-indictment in Defamation Lawsuit

We represented a dean of a state college in a criminal defamation lawsuit; the Taiwan Taoyuan District Prosecutors’ Office made a non-indictment decision per our defense.

The Prosecutor, in the non-indictment decision, held that our client did not commit defamation by spreading offensive statements that tends to injure the complainant’s reputation. On the contrary, the Prosecutor held that the complainant, as a professor, who was involved with a plagiarism allegation should be subject to public criticism.

This case was led by our founding partner, Dr. Ching-Yuan Yeh, with the assistance of Mr. Wei-Jiun Hung. Dr. Yeh, with an S.J.D. and a J.D. from University of Pennsylvania, is an expert of free speech. He is an experienced litigator who advises clients on civil/criminal defamation procedure matters. Mr. Hung earned an LL.M. degree and an LL.B. degree from National Chengchi University. He has experience in multiple fields of litigation such as civil, criminal and administration procedure.
