Titan Successfully Challenged a Fine of NT$ 1 Million for an LPG Equipment Manufacturer

We represented a liquefied petroleum gas equipment manufacturer to overturn a fine of NT$ 1 million issued by the Ministry of Economic Affairs Bureau of Standards, Metrology and Inspection (the “Bureau”).

The Bureau had initially ruled that valves manufactured by the client violated Taiwan’s Commodity Inspection Act and ordered the alleged violation be rectified or the product recalled within 5 days. After the impractical recall period, the Bureau fined our client.

Upon appeal to the MOEA’s Administrative Committee, the Bureau’s original order was reversed and the Bureau is required to issue a revised order within three months.

Dr. Ching-Yuan Yeh, our managing partner, led the engagement, assisted by senior associates Ms. Ya-Ling Cheng, and Mr. Wei-Jiun Hung. Dr. Yeh has over twenty years’ experience and previously practiced at Taiwan’s Lee & Li as well as global law firm Sullivan & Cromwell LLP. Before joining Titan Ms. Cheng worked in the legal departments of major financial and manufacturing companies in Taiwan; Mr. Hung is an experienced litigator who advises clients on civil, criminal and administrative procedure matters.
