Taiwan’s Supreme Court held that online gambling, if limited to registered users, does not constitute the offense of “Gambling in Public” under Art. 266(1) of the Criminal Code. However, the Supreme Court did not rule out the possibility that online gambling may constitute the “Gambling Behavior” under Art. 84 of the Social Order Maintenance Act, under which a fine of NT$9,000 or less may apply.
